SC Raps Delhi Government as Nation Capital Chokes Under Toxic Smog

The Supreme Court on Monday issued a stern warning to the Delhi government over its delay in implementing stricter measures under the Graded Response Action Plan (GRAP-4) to combat severe air pollution in the national capital.

The Bench of Justices Abhay S Oka and Augustine George Masih directed the government not to scale down preventive measures under stage 4 of GRAP without prior permission from the court. The court pointed out that despite the Air Quality Index (AQI) reaching alarming levels, the Delhi government had delayed in implementing stage 4 of GRAP, which was mandated by law.

The counsel for the Delhi government informed the Bench that stage 4 of GRAP has been implemented and heavy vehicles have been banned from entering the national capital. However, the court expressed its disappointment and dismay over the delay in implementation.

"The moment the AQI reaches between 300 and 400, stage 4 has to be invoked. How can you take risk in these matters by delaying applicability of stage 4 of GRAP," the bench told the counsel.

The Commission for Air Quality Management (CAQM) had announced stricter pollution control measures under GRAP-4 effective from Monday, including a ban on truck entry and a temporary halt on construction at public projects. Delhi's Air Quality Index (AQI) worsened to 441 at 4 pm and rose to 457 by 7 pm due to unfavourable weather conditions.

"The moment the AQI reaches between 300 and 400, stage 4 has to be invoked," the bench said, adding that it will not allow scaling down of preventive measures under stage 4 even if the AQI goes below 450. "Stage 4 will continue till court permits."

The court has scheduled its hearing on the matter for later today. The Delhi government had been facing criticism over its inability to effectively curb the alarming rise in pollution levels in the national capital, which has severely impacted the quality of life of residents.

As a result of the poor air quality, many people, including office-goers, have been advised to wear face masks while stepping out. The pollution situation is still critical and health experts are warning about the dangers of prolonged exposure to toxic smog.
