Heavy Goods Truck Repossessed Amidst Loan Repayment Dispute
Barabanki, Uttar Pradesh - Sher Singh, a local resident who had financed a heavy goods truck through a bank loan, faced an abrupt repossession of his vehicle under contentious circumstances. Singh had secured a loan of Rs 16.55 lakh to purchase the truck, with repayment structured in 47 equated monthly instalments (EMIs) of Rs 45,600 each.
Trouble began when Singh reported significant defects in the truck, leading to financial losses and subsequent delays in his EMI payments. Seeking relief, he approached the bank for an extension, which was granted, allowing him to make a part payment on November 23, 2012.
However, just two days later on November 25, 2012, Singh's truck was forcibly taken by a group of 8 to 10 musclemen at Haidargarh in Barabanki District. The repossession was executed without any formal notice or legal process, raising concerns over the methods used by recovery agents.
Singh has since approached local authorities to address this unlawful seizure, highlighting the need for better regulation and oversight of vehicle repossession practices. The incident has sparked a discussion on the rights of borrowers and the aggressive tactics sometimes employed by recovery agents, prompting calls for stricter enforcement of legal and ethical standards in debt recovery operations.
This case underscores the ongoing challenges faced by borrowers in their interactions with financial institutions, especially when disputes arise over asset-backed loans.
