Attorney General Opposes Constitutional Amendments, Calls for Democracy Over Authoritarianism

Bangladesh's Attorney General Md Asaduzzaman has sparked controversy by suggesting that the word "secular" be removed from the nation's Constitution, citing that 90% of the population is Muslim. He also expressed opposition to the title of "father of the nation" for Sheikh Mujibur Rahman, the father of ousted Prime Minister Sheikh Hasina.

During a court hearing on the legality of the 15th Amendment, Asaduzzaman argued that the amendments should reflect democracy and avoid promoting authoritarianism. He criticized Articles 7A and 7B, which prevent any amendments or changes that could "subvert democracy", claiming that these provisions actually weaken democracy by limiting reforms and entrenching political power.

The Attorney General believes that the provisions seek to prolong dictatorship for ulterior motives and are "antithetical" to the rule of law. In a clear rebuff to critics, he stated that the Jamaat-e-Islami is running its agenda in the country.

Asaduzzaman's comments have drawn comparisons with the Muhammad Yunus government, which was known for promoting democracy and opposing authoritarianism. The protests that led to Sheikh Hasina's resignation in August 2024 were sparked by a long-running resentment over a reservation system, which saw 56% of government positions reserved for various groups.

The controversy has reignited concerns about the country's commitment to democracy and human rights. Asaduzzaman's stance is likely to further polarize the nation, with many expressing alarm at the suggestion that the Constitution be altered to reflect a more authoritarian tone.

With the fate of constitutional amendments hanging in the balance, it remains to be seen whether Asaduzzaman's views will shape the future of Bangladesh. The country's democracy and human rights record are watching anxiously as the situation unfolds.
